The car’s windshield appeared to be fogged or frosted over, obstructing the driver’s view. The officer decided to initiate a traffic stop on the vehicle for the violation. As the car was pulling to a stop, the officer could see the passenger reaching in the back seat and moving his arm quickly. The officer also observed the passenger lean forward as if to hide contraband or a weapon. The officer approached the vehicle with caution and told the driver why he was stopped. The driver stated his windshield wipers didn’t work and the windshield was obstructed by salt residue from the roads. The officer asked the passenger what he was reaching for in the back seat. The passenger asked what the officer meant and then reached under his seat. The officer advised the passenger to keep his hands in the officer’s view. Upon further questioning, the passenger came clean and told the officer he had hid marijuana and a pipe. In the back seat the officer located a large jar full of what appeared to be marijuana, a pipe and a grinder. The green leafy substance was field tested and tested positive for marijuana. All illegal items were seized and destroyed. The passenger was cited for possession of a controlled substance and released. The driver was verbally warned for not having a clear windshield.
