A Sartell man was sentenced to one year in jail after he admitted to hitting and killing a pedestrian while drinking while intoxicated.
Tyler Nies, 26, was driving a pickup north on Benton Drive one day last summer when he struck a pedestrian, identified as Kevin Donald Oehmen, 47, of St. Cloud, who died of his injuries.
Nies told officers he saw a man walking on the grass by the curb and tried to slam on his brakes when the man stepped onto the road and then he couldn’t stop his pickup.
Officers administered field sobriety tests at the scene. The criminal complaint stated Nies’s blood alcohol level was .129 percent. The legal blood alcohol level in Minnesota is 0.08 percent.
At his court appearance, Nies pled guilty to criminal vehicular homicide. His sentence includes a six-year suspended prison sentence, 80 hours of community service, mandatory chemical-dependency evaluations, attending a victim-impact panel, a 10-year probationary period and not ingesting alcohol and/or drugs.
